This Privacy Policy describes how Afterify, LLC ("Afterify", "we", "us", or "our") collects, uses, and shares your personal information when you visit https://afterify.com (the "Site") or use our products and services — including Afterify Studio, the Website Builder, client galleries, digital storage, and the integrated Store (collectively, the "Services").

Information We Collect

Account Information

When you register for an account, we collect information such as your name, email address, and password, along with your plan selection and account settings. If you contact us for support, we also collect the information you choose to share in those communications.

Billing and Order Information

When you subscribe to a paid plan, or when you make or attempt a purchase through the Site or a store powered by Afterify, we collect information such as your name, billing address, shipping address, email address, phone number, and payment details. Payment card numbers are collected and processed by our third-party payment processors — we do not store full card numbers on our systems. We refer to this information as "Order Information."

Content You Upload

The Services store the photographs, images, text, and other files you upload or create — for example the content of your galleries, websites, and store listings. We access this content only as needed to provide the Services (such as hosting, resizing, and displaying it as you direct), to comply with law, or to enforce our Terms of Service.

Device Information

When you visit the Site, we automatically collect certain information about your device, including your web browser, IP address, time zone, and some of the cookies installed on your device. As you browse, we also collect information about the pages or products you view, the websites or search terms that referred you, and how you interact with the Site. We refer to this automatically collected information as "Device Information." We collect it using the following technologies:

• "Cookies" are data files placed on your device that often include an anonymous unique identifier. For more information about cookies and how to disable them, visit allaboutcookies.org.
• "Log files" track actions occurring on the Site and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.
• "Web beacons," "tags," and "pixels" are electronic files used to record information about how you browse the Site.

Information About Your Clients and Customers

If you use the Services to share galleries with your clients or to sell through your store, we process information about your clients and customers (such as their names, email addresses, order details, and gallery activity) on your behalf, in order to provide the Services to you. You are responsible for having a lawful basis to collect that information and for responding to your clients' privacy requests; we use it only to provide the Services and as described in this policy.

When we talk about "Personal Information" in this Privacy Policy, we mean all of the categories above.

How We Use Your Personal Information

We use Personal Information to:

• provide, operate, and maintain the Site and Services, including hosting your account and content;
• process subscriptions and orders, including payments, invoices, and order confirmations;
• communicate with you about your account, transactions, and changes to our terms or policies;
• respond to your support requests;
• screen orders and account activity for potential risk or fraud (in particular using your IP address);
• improve and optimize the Site and Services, for example by generating analytics about how visitors browse and interact with the Site;
• where in line with the preferences you have shared with us, send you information or advertising relating to our products or services;
• comply with legal obligations and enforce our agreements.

Payment Processing

We use third-party payment processors, which may include PayPal and Stripe. Transactions processed by them are governed by their own privacy policies and terms, which we recommend you review: PayPal's privacy policy and Stripe's privacy policy.

How We Share Your Personal Information

We share Personal Information with service providers who help us operate the Site and Services, and only as needed for them to perform those services. These include:

• cloud hosting and infrastructure providers that store our data and run the Services;
• payment processors, as described above;
• analytics providers — for example, we use Google Analytics to help us understand how visitors use the Site. You can read how Google uses your Personal Information and opt out of Google Analytics;
• email and communication providers we use to send you transactional and, with your consent where required, marketing messages.

We may also share Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant, or other lawful request for information we receive, or to otherwise protect our rights, our users, or others. If Afterify is involved in a merger, acquisition, financing, or sale of assets, Personal Information may be transferred as part of that transaction; we will notify you of any change in ownership or in the uses of your Personal Information. We do not sell your Personal Information.

Behavioural Advertising

You can opt out of targeted advertising through:

• Facebook ad settings
• Google ad settings
• Microsoft (Bing) ad settings

Additionally, you can opt out of some of these services by visiting the Digital Advertising Alliance's opt-out portal.

Do Not Track and Global Privacy Control

We do not currently respond to Do Not Track browser signals. Where required by applicable law, we honor opt-out preference signals such as the Global Privacy Control (GPC) as a request to opt out of targeted advertising.

Your Rights — European Economic Area and United Kingdom

If you are located in the EEA or the UK, you have the right to access the personal information we hold about you, and to request that it be corrected, updated, deleted, or ported to another service. You may also object to or ask us to restrict certain processing, and where processing is based on consent, withdraw that consent at any time. To exercise these rights, contact us using the details below. You also have the right to lodge a complaint with your local data protection supervisory authority.

We process your information to fulfill contracts we have with you (for example, to provide the Services you signed up for), to pursue our legitimate business interests as described above, to comply with our legal obligations, or with your consent. Your information may be transferred outside of Europe, including to Canada and the United States; where we do so, we rely on appropriate safeguards such as standard contractual clauses.

Your Rights — US State Privacy Laws

Depending on your state of residence (including California, Colorado, Connecticut, Virginia, and others with comprehensive privacy laws), you may have the right to: know what categories of personal information we collect and how we use and share them (as described in this policy); access the personal information we hold about you; correct inaccurate information; delete your information; and opt out of targeted advertising. We do not sell personal information, and we do not use or disclose sensitive personal information for purposes requiring a right to limit under applicable law. We will not discriminate against you for exercising any of these rights. To exercise them, contact us using the details below; you may also authorize an agent to submit a request on your behalf. If we decline a request, you may appeal by replying to our decision, and we will review the appeal.

Data Security

We work to protect your Personal Information from unauthorized access, use, and disclosure using appropriate physical, technical, organizational, and administrative security measures based on the type of data and how we process it. You can help protect your data by choosing a strong password, limiting access to your devices and browser, and signing out after accessing your account. No method of transmitting or storing data over the internet is completely secure, so we cannot guarantee absolute security.

Data Retention

We retain Personal Information for as long as you have an open account with us or as otherwise necessary to provide the Services, and for a limited period afterwards — generally up to two years, or until we receive a request to delete it. In some cases we retain Personal Information longer where necessary to comply with our legal obligations, resolve disputes, or collect fees owed, or where otherwise permitted or required by applicable law. We may retain information in an anonymized or aggregated form that no longer identifies you.

Children's Privacy

The Services are not directed to children, and we do not knowingly collect Personal Information from children under 16 years of age. If you are under 16, please do not register for the Services or send us any Personal Information. If we learn that we have collected Personal Information from a child under 16, we will delete it as quickly as possible. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes to our practices or for operational, legal, or regulatory reasons. We will alert you to material changes by placing a notice on the Site, by sending you an email, or by other means, and we will update the "Last updated" date above. Your use of the Services after changes take effect means you accept the revised policy. Use of information we collect is subject to the Privacy Policy in effect at the time the information is collected.
